1. Scope of the General Terms and Conditions
Fotichaschte Events GmbH provides its services exclusively on the basis of the following General Terms and Conditions (GTC).
2. Prices
The price listed in the price list, or individually agreed upon, includes all services listed. Additional services are agreed upon and invoiced individually. Fotichaschte Events GmbH reserves the right to adjust the package prices and their included services at any time. Equipment insurance is not included in the price. This can either be booked directly, or the renter can arrange their own insurance.
3. Payment
The invoice is due in full within 30 days of the invoice date, but no later than 7 (seven) days before the event. If the invoice is not paid 7 days before the event, Fotichaschte Events GmbH reserves the right not to deliver the rented photo booth. After the payment deadline, late payment interest of 5% is due. In addition, an administration fee of CHF 50 will be charged for each reminder. Fotichaschte Events GmbH reserves the right to assign outstanding claims to a debt collection agency or to commission a debt collection agency to collect the claim. Any additional costs incurred will be passed on to the customer.
Fotichaschte Events GmbH reserves the right to conduct a credit check for larger orders.
4. Cancellation and revocation of contract
If the customer cancels between the booking and 60 days before the event, the customer may withdraw from the contract upon payment of a fee of CHF 100 (administrative expenses, consulting, etc.). Any costs already incurred at this time (ordering materials, graphic work, etc.) will be invoiced at 100% (hourly rate: CHF 160). Cancellations made after this time will be handled as follows:
- 59 to 14 days before the event: 50% of the total amount
- Less than 14 days before the event: 75% of the total amount
5. Liability and compensation
Fotichaschte Events GmbH is only liable for damages of any kind if intent or gross negligence can be proven. Should the customer discover any defects/malfunctions, they are obligated to report them immediately (support is available from 9:00 a.m. to 11:00 p.m.). Defects/malfunctions reported afterward will not be accepted.
Upon return, the equipment will be tested and inspected by Fotichaschte Events GmbH. Any defects not caused by normal use will be charged to the customer.
Fotichaschte Events GmbH ensures that the provided equipment will be operational for at least 80% of the agreed rental period. If a failure occurs during the rental period due to gross negligence on the part of Fotichaschte Events GmbH, resulting in the services not being provided as agreed, the customer will be granted a proportional reduction of the total rental price.
6. Copyright, data backup and right of use
The customer accepts that the personal data necessary to process the order will be stored on data storage media. By finalizing the booking, the customer consents to the collection, processing, and use of their personal data. The customer has the right to delete the data and revoke their consent at any time, provided the agreed services have been completed.
All photos/videos/GIFs created will be made available to the customer electronically after the event. The customer is responsible for backing up this data in compliance with data protection regulations. All photos/GIFs/videos will be deleted after 6 (six) months.
For all files transferred to Fotichaschte Events GmbH (images, sound, etc.), it is the customer’s responsibility to ensure that he has all usage rights necessary for the implementation of the event.
Fotichaschte Events GmbH is considered the copyright owner of all photographs taken as part of the rental. These photographs are protected by copyright. The customer is granted a right of use for the publication of the photographs. The transfer of this right of use requires the consent of Fotichaschte Events GmbH. Fotichaschte Events GmbH may request to be named as the copyright owner of the photographs. In this case, the note “©Fotichaschte.ch” must be placed under the photos.
7. Reference
After the event has taken place, Fotichaschte Events GmbH is entitled to list the contractual partner as a reference customer (including company logo) and to use it for advertising purposes.
8. Final provisions
If certain provisions of these general terms and conditions become invalid, all other contractual conditions remain valid.
9. Place of jurisdiction
Swiss law generally applies. The courts of Zurich have jurisdiction for any legal action. If the customer resides abroad, Zurich is also the place of jurisdiction.
